着床前診断(PGT-A)の政略的な利用は倫理的といえるのか 　――日本の皇室における文仁親王（日本の皇位継承者）と紀子妃の企み――

Here we give an interesting case of gender discrimination by PGT-A.

 

着床前診断(PGT-A)による興味深い性差別の事例をここに紹介します。

 

The Japanese Constitution decrees (Article 2) that the succession to thethrone should be hereditary, the details of which are relegated to the imperial house law. The Imperial House Law claims (Article 1) in turn that the throne is inherited by a male member of the male line belonging to the imperial line, which is the fundamental tenet of Salic Law (https://en.wikipedia.org/wiki/Salic_law).

 

日本国憲法は、第2条により皇位継承を世襲と定め、その詳細は皇室典範に委ねられるとしています。皇室典範は第1条により、皇位とは皇統に属する男系男子が継承するものと定めていますが、これはサリカ法（注1）の基本理念でもあります。

 

It is no longer easy to be stubbornly loyal to the platform of male succession in confrontation with the unrelenting fact that fewer children are commonplace and concubines are no longer admitted in modern societies. Indeed, it is no longer possible at present to find a royal family with Salic Law in Europe.

 

現代社会において少子化は当たり前のことで、側室制度も認められなくなっています。この切実な状況にあっても、なお頑なに男系男子の継承を守ろうとするのは、もはや容易なことではありません。実際に、現在のヨーロッパでサリカ法に従う王室を見つけることは不可能です。

 

At the end of 2004, an expert meeting on the imperial house law was established as an advisory body for then Prime Minister Junichiro Koizumi. The meeting was held seventeen times, finally giving a report admitting female emperors and female succession by expansion of eligibility for succession to the throne on 24 November 2005.

 

2004年の暮れ、当時の小泉純一郎首相の諮問機関として、皇室典範に関する有識者会議が設けられました。皇位継承をめぐっての会議は17回開催され、最終的には皇位継承資格を有する者を拡大するとして、女性天皇および女系天皇を認める旨の報告書が2005年11月24日に提出されました。

 

In response to this report, then incumbent Prime Minister Koizumi said that he would proceed with preparations to submit the bill to the ordinary session of the Diet in the following fiscal year, Liberal Democratic Party secretary-general Tsutomu Takebe, Komeito secretary-general Tetsuzo Fuyushiba, Japanese Communist Party Secretary-General Tadayoshi Ichida, and Social Democratic Party leader Mizuho Fukushima all said they would accept the contents of the report, while Yukio Hatoyama, secretary-general of the Democratic Party of Japan, had not specifically denied this.

 

その報告書を受け、当時の小泉首相は翌年度の通常国会に法案を提出する準備に入ると述べました。民主党の鳩山由紀夫幹事長は特段否定をせず、自民党の武部勤幹事長、公明党の冬柴鐵三幹事長、日本共産党の市田忠義書記局長、社民党の福島瑞穂党首は、いずれも報告書の内容を容認することを発表しました。

 

The situation changed drastically when the pregnancy of Princess Kiko of Akishino at the age of 39 was reported on 7 February 2006. Seeing this new development, Prime Minister Koizumi announced at the Budget Committee meeting the next day that he would not approve the revision of the Imperial House Law. Prince Hisahito was born with height 48.8cm and weight 2558g on6 September 2006. In this way, the sacrosanct principle of male-member-male-line was barely saved.

 

状況は2006年2月7日、当時39歳だった秋篠宮妃紀子さまのご懐妊が伝えられたことで一変しました。新たな展開を知り、小泉首相は翌日に開かれた予算委員会の場で、皇室典範の改正を承認しない旨を明らかにしました。2006年9月6日、悠仁親王は身長48.8センチメートル、体重2,558グラムで誕生しました。こうして、男系男子による皇位継承の原則がかろうじて守られたのです。

 

Last year, the news that Fumihito confessed that Kiko’s pregnancy with Hisahito was due to PGT-A shocked every Japanese. How to deal with gender discrimination by PGT-a is a difficult problem. It is legalized in USA, but it is forbidden in Europe and Japan. In any case, political exploitation of PGT-A is extremely rare.

 

昨年、文仁親王が男児（悠仁さま）を授かったのは着床前診断のおかげだ(注2)と自ら告白したという話が広がり、日本の国民全体がショックを受けました。着床前診断での男女産み分けという性差別を、どう受け止めるかは難しい問題です。男女産み分けは、米国では合法化されていますが、ヨーロッパと日本では禁止されています（注3）。いずれにおいても、着床前診断の政略的な利用は極めて稀です。

 

This story reminds me of Johann Wolfgang von Goethe’s Faust, in which Faust meets the devil Mephisto and makes a contract with him to experience all the pleasures and sorrows of life in this world in exchange for the submission of his soul after death.

この話は私に、ヨハン・ヴォルフガング・フォン・ゲーテの戯曲『ファウスト』を思い出させます。ファウストは悪魔メフィストと出会い、死後の魂をメフィストに引き渡すことを条件に、この世の快楽と悲しみのすべてを経験させてもらうという契約を結びます。

 

Faust falls in love with a simple town girl, Gretchen, and eventually conceives a child, while he kills her mother and her elder brother. Faust really gets every success in this world, so that his soul has no sooner been about to fall under the arms of Mephisto than is saved by pray of Gretchen in Heaven.

 

ファウストはごく普通の町娘グレートヒェンと恋に落ち、彼女を身ごもらせ、一方でその母親と兄を殺してしまいます（注4）。この世のすべての成功を手に入れたファウストは、今にも魂がメフィストの手中に落ちるところでしたが、亡きグレートヒェンの天上の祈りのおかげで救われました。

 

Fumihito and Kiko have succeeded in usurping the throne by making a contract with Mephisto, but who will pray for them? May God bless Fumihito and KIKO.

 

メフィストと契約でも交わしたかのように、皇位継承の略奪に成功した文仁親王と紀子妃。しかし、彼らのために誰が祈りを捧げてくれるのでしょうか。文仁親王と紀子妃に神のご加護がありますように。

6世紀のフランク王国で王位継承法に関して定められた「サリカ法」は、女王および女系国王を禁じていた。

（注2）
体外受精により得られた複数の胚について、染色体数を検査することで男女産み分けは可能になる。着床前診断として、いくつもの受精卵（胚）を対象に性別が決まる性染色体の「Ｘ染色体」と「Ｙ染色体」の数を調べ、男女を判定。希望の性別の胚を女性の子宮に移植する。

（注3）
現在の日本において、着床前の胚についての染色体異数性検査が許可されているのは、親に遺伝子変異があることで発症が予想される、先天性魚鱗癬、デュシェンヌ型筋ジストロフィー、ベッカー型筋ジストロフィー、血友病ほかの重篤な病気を防ぐ目的のみ。申請があったケースについて倫理委員会が慎重に審議する。近年は日本にも、流産を減らす目流で着床前診断を行う海外の検査機関を紹介する組織が存在する。

（注4）
ファウストは、グレートヒェンとの逢瀬をよく思わない彼女の母親を、邪魔だとして殺害。激怒した彼女の兄も決闘の末に殺す。ファウストと恋愛した自分のせいで家族2人を死なせた苦悩から、グレートヒェンは誕生したわが子を殺し、嬰児殺害のため処刑された。
